1. Liability

All work is undertaken at the customer's own risk. In the event of proven gross negligence on our part, Excess Luggage's liability is limited to R1000 per shipment. All other types of loss or damage are excluded (including but not limited to lost profits, income, interest or future business). Excess Luggage is not liable for any loss or damages imposed by other parties (including but not limited to airlines, handling agents or customs.) All claims must be submitted in writing to Excess Luggage within thirty (30) days of Excess Luggage's acceptance of shipment, failing which, Excess Luggage will have no liability whatsoever.

2. Shipment insurance

We are unable to offer any comprehensive insurance cover. South African Law dictates that only accredited financial advisors are allowed to offer insurance services. Excess Luggage can, however, direct you to such service providers.

3. Disclaimer

Excess Luggage reserves the right to refuse transportation of a shipment at any time in the transit procedure and is not legally liable in any way, in the following cases:

  1. The customer submits for removal, packing, warehousing and transferring any dangerous, damaging, corrosive, explosive or illegal articles or substances.
  2. No or false customs declaration is made by the customer when required by applicable customs regulations.
  3. Excess Luggage decides that the shipment is unsafe or illegal (including but not limited to animals and animal products; plant and plant products; currency; precious metals and stones; firearms and their parts and ammunition; pornography and illegal narcotics and drugs.
4. Inspection

Excess Luggage has the right to inspect a shipment without prior notice to the customer.

5. Deliveries
  1. Shipments cannot be delivered to Post Office (P.O.) Boxes.
  2. Door–to–door shipments are delivered to the customer's address and not necessarily to the customer personally.
  3. Door–to–airport shipments must be collected and custom cleared by the person whose name appears on the waybill. Shipments cannot be handed over to a 3rd party without prior arrangements.
  4. If the customer refuses delivery or fails to pay for the delivery; or the shipment is deemed unsafe or unacceptable or is undervalued by the customer for customs purposes; or the customer cannot be located; Excess Luggage will return the shipment to the customer at the customer's cost. Failing this, Excess Luggage reserves the right to dispose of or sell the shipment in order to retrieve any costs incurred to Excess Luggage.
6. Charges

It is standard industry practice to compare the actual weight and volumetric weight of a shipment and charge for the higher of the 2 values. Any shipment may be re–weighed and re–measured by Excess Luggage to confirm calculations. Excess Luggage will then charge accordingly.

Excess Luggage is not liable for any additional charges (including but not limited to storage charges at destination, handling fees at destination, duties or taxes owed or fines incurred during transportation, customs charges and fines incurred.)

In the case of door-to-airport shipments, it is the customer's responsibility to collect the goods timeously to avoid extra storage costs. Excess Luggage cannot be held responsible for any charges or fines imposed by customs or any other government official.

7. Circumstances beyond our control.

Excess Luggage is not liable for any loss, damage or delays arising out of circumstances beyond its control. These include, but are not limited to 'Acts of God' e.g. Earthquakes, floods, storms, fog; 'Force Majeure" e.g. war, plane crash or embargo; riot, strikes and any act or omission by a person not employed by Excess Luggage e.g. customs delays, lack of flight availability, re–routing by airline or off-loading of shipment by airline or confiscations by customs or any other government official.

8. Jurisdiction

Any dispute or claim arising out of the contract or the interpretation thereof and any litigation between the customer and Excess Luggage shall be adjudicated upon by a competent Magistrate's or Supreme Court, having jurisdiction in the district within Excess Luggage's office within which the contract was made.
